Welcome to Similarix! These Terms and Conditions ("Terms") govern your access to and use of the Similarix service, including our website https://similarix.com, mobile applications, and any related services (collectively, the "Service") provided by Premium Software Ltd. ("we", "us", or "our"), a company registered in Bulgaria.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

1. Definitions

Our Service is designed to provide Semantic Search for images in S3 buckets. By using our Service, you agree to the following:

• You will use the Service only for lawful purposes and in accordance with these Terms.
• You will not use the Service in any way that violates any applicable local, state, national, or international law or regulation.
• You will not attempt to gain unauthorized access to any portion or feature of the Service, or any other systems or networks connected to the Service or to any of our servers.
• You acknowledge that our Service provides read-only operations, ensuring your data remains unchanged and secure.
• You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer or device.

3. Account and data

By creating an account with us, you agree to the following:

• You will provide accurate, current, and complete information during the registration process and keep such information updated.
• You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
• You may request data deletion at any time by contacting us at [email protected].
• Upon account deletion, all associated data will be removed from our servers within 30 days, except where we are required to retain it by law.
• We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel orders in our sole discretion.

4. Intellectual property rights

The Service and its original content, features, and functionality are and will remain the exclusive property of Premium Software Ltd. and its licensors. The Service is protected by copyright, trademark, and other laws of both Bulgaria and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Premium Software Ltd.

5. User content

You retain any and all of your rights to any Content you submit, post, or display on or through the Service and you are responsible for protecting those rights. We take no responsibility and assume no liability for Content you or any third party posts on or through the Service.

6. Prohibited uses

You may not use the Service:

• In any way that violates any applicable law or regulation.
• To impersonate or attempt to impersonate the Company, a Company employee, another user, or any other person or entity.
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which, as determined by us, may harm the Company or users of the Service or expose them to liability.
• To attempt to bypass any measures of the Service designed to prevent or restrict access to the Service, or any portion of the Service.

In no event shall Premium Software Ltd., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

These Terms shall be governed and construed in accordance with the laws of Bulgaria, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Service after any revisions become effective, you agree to be bound by the revised terms.
